Missouri’s Cell Phone Use While Driving Laws

In the state of Missouri, drivers who are 21 years old or younger are prohibited from driving while sending or receiving messages on a cellphone or other hand-held device. Commercial drivers must also abide by this law regardless of their age.

There are some exceptions such as if the driver is operating an authorized emergency vehicle or the driver used a hand-held device to report illegal activity, summon emergency assistance, or prevent injury to a person or property.

Missouri law does still allow the use of voice-operated technology or hands-free devices. It is important to work with an auto accident attorney who knows the specific laws around cell phone use and how to build a case for you.

Important Take-Aways From This:

  • If you have a driver that is 21 years or younger, make sure they have access to hand free calls in their vehicle for emergencies OR stress that they CAN’T under any circumstances (except for the situations listed above) text while driving.
  • You should get legal advice from an EXPERIENCED attorney who is familiar with these matters as soon as possible if you’re involved in a car accident caused by a driver who was texting and driving.
